SUBSCRIPTION AGREEMENT

To make your use of the Access Service as enjoyable as feasible, in addition to the terms and conditions of this Agreement, Harbour Communication, Inc. requires its subscribers to abide by the rules of conduct described in  Harbour Communication, Inc.'s Acceptable Use Policy. By subscribing to a Harbour Communication, Inc.'s internet access account, you agree to abide by Harbour Communication, Inc.'s Acceptable Use Policy and agree that those policies are incorporated into this Agreement by reference.

Harbour Communication, Inc. may modify this Agreement or the terms of the Acceptable Use Policy from time to time by placing a notice of such modification on our policy updates page and your continued use of the internet service provided by Harbour Communication, Inc. more than fourteen days following notice of this modification shall be conclusively presumed to be an acceptance of the modification. It is a subscriber's responsibility to check this online area regularly to determine whether the Subscription Agreement or the Acceptable Use Policy has been modified. If a subscriber does not agree to any modification of this agreement, the subscriber must cease using the services provided by Harbour Communication, Inc. within 14 days after the modification was posted.

You agree that if Harbour Communication, Inc. terminates your account as a result of your violation of the Acceptable Use Policy, you forfeit any rights to a refund of any prepaid account charges, such forfeiture being agreed by you and Harbour Communication, Inc. as liquidated damages and not a penalty. You further agree that if you violate Harbour Communication, Inc.'s Acceptable Use Policy, Harbour Communication, Inc. may refuse to accept any application for renewal or resubscription following cancellation.

 



ACCEPTABLE USE POLICY

Harbour Communication, Inc.

Internet Access Accounts

As an internet services subscriber of Harbour Communication, Inc., I agree to follow the ACCEPTABLE USE POLICY of Harbour Communication, Inc. The ACCEPTABLE USE POLICY is part of the Subscriber Agreement and is incorporated therein by reference.

  • All use of Harbour Communication, Inc. network services shall be intended to facilitate the exchange of information and otherwise be consistent with the broad objectives of Harbour Communication, Inc.


  •  

  • Users of Harbour Communication, Inc. network services shall promote efficient use of the networks to minimize, and avoid if possible, unnecessary network traffic and interference with the work of others of the  interconnected networks.

  • Users of Harbour Communication, Inc. network services shall not disrupt any of the Harbour Communication, Inc. networks as a whole or any equipment or system forming part of its systems, or any services provided over, or in  connection with, any of the Harbour Communication, Inc. networks.


  •  

  • Harbour Communication, Inc. networks shall not be used to transmit any communication where the meaning of the message, or its transmission or distribution, would violate any applicable law or regulation or would likely be  highly offensive to the recipient or recipients thereof.

  • Harbour Communication, Inc. networks may be used for purposes consistent with the goals of Harbour Communication, Inc.


  •  

  • Advertising may not be "broadcast" or otherwise sent on an intrusive basis to any user of the Harbour Communication, Inc. network or any directly or indirectly attached network. However, when requested by a user  of the networks, product information, and other commercial messages are permitted to be transmitted over the network. Discussion of a product's relative advantages and disadvantages by users of the product, and vendors'  responses to those who pose questions about their products, may be made available over the Harbour Communication, Inc. networks.

     
  • Subscribers shall not restrict or inhibit any other subscribers' use or enjoyment of the networks.


  •  

  • Interpretation, application, and possible modification of this Acceptable Use Policy shall be within the sole discretion of Harbour Communication, Inc.  Questions about any issue arising under this Policy should be  directed to Harbour Communication, Inc. by attaching Organizations when an issue first arises.
